These Terms of Use (“Terms”) govern your access to and use of Common Porch, including the mobile application, web application, AI-powered features, and related services (collectively, the “Services”).
Common Porch is developed and operated by CareFlick, Inc. (“CareFlick,” “we,” “our,” or “us”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or 16 where required by law) and legally capable of entering into a binding agreement to use the Services.
2. Nature of the Service
Common Porch is a daily engagement and companionship platform powered by artificial intelligence (“AI”).
The Services are not medical, healthcare, legal, financial, professional, or emergency services and must not be used for emergency, crisis, or life-threatening situations.
3. AI-Powered Features & Transparency
3.1 AI Community Managers
Common Porch uses AI-powered, human-like avatars (“AI community managers”) to interact with users.
You acknowledge and agree that:
You are interacting with AI systems, not real humans
AI responses are generated automatically based on user input, preferences, and contextual information
AI does not possess consciousness, emotions, or intent
AI-generated responses may be incomplete, inaccurate, or inappropriate in certain situations
You agree to use your own judgment when relying on any information provided by the AI.
3.2 Vision & Camera-Based Features
Certain features may optionally use your device’s camera.
If enabled:
AI may process visual cues (such as gestures or objects) to improve real-time conversational relevance
Visual data is handled ephemerally where possible and retained only as necessary to support functionality, personalization, and safety
Explicitly excluded uses:
No facial recognition
No identity verification
No surveillance
No profiling or advertising
No cross-session visual tracking
Camera access is optional and can be disabled at any time through your device or app settings.
3.3 AI Safety Boundaries
To protect users:
AI systems are designed to avoid providing medical, legal, financial, or emergency advice
Certain requests may trigger safe responses or redirection
AI systems are monitored and improved over time to reduce harmful or misleading outputs
All AI interactions are provided for general engagement and informational purposes only.
4. No Medical, Legal, or Professional Advice
The Services do not provide medical, clinical, diagnostic, legal, financial, or other professional advice.
You agree that:
You will not rely on the Services for such advice
You will seek qualified professionals for medical, legal, financial, or emergency matters
CareFlick is not responsible for decisions or actions taken based on AI-generated content
5. User Responsibilities
You agree to:
Use the Services lawfully, respectfully, and for personal, non-commercial purposes
Provide accurate information where required
Exercise reasonable judgment when interacting with the Services
You agree not to:
Use the Services for emergency or crisis situations
Attempt to bypass safety features or safeguards
Reverse engineer, scrape, or exploit AI systems
Upload or share unlawful, abusive, or harmful content
Use the Services to harm yourself or others
CareFlick may suspend or terminate access for violations of these Terms.
6. Privacy Policy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Personalization & Data Use
Your interactions may be used to personalize responses, improve AI performance, and enhance service reliability, as described in the Privacy Policy.
Personalization does not involve automated decision-making with legal or similarly significant effects.
8. Intellectual Property
All content, software, AI models, designs, avatars, trademarks, and features within Common Porch are owned by or licensed to CareFlick, Inc.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.
You may not copy, modify, distribute, sell, or create derivative works from the Services without prior written permission.
9. User Content
You retain ownership of content you submit (such as messages or feedback).
By using the Services, you grant CareFlick a limited license to use, process, and analyze your content solely to operate, maintain, personalize, and improve the Services.
10. Service Availability & Changes
CareFlick may modify, suspend, or discontinue any part of the Services at any time, including AI features or functionality.
We do not guarantee uninterrupted or error-free operation.
11. Termination
You may stop using the Services at any time.
CareFlick may suspend or terminate access if:
You violate these Terms
Required by law
Necessary to protect users, CareFlick, or the Services
Sections relating to disclaimers, liability, and intellectual property survive termination.
12. Disclaimers
The Services are provided “as is” and “as available.”
To the fullest extent permitted by law:
CareFlick disclaims all warranties, express or implied
We do not guarantee accuracy, reliability, or suitability of AI-generated content
Use of the Services is at your own risk
13. Limitation of Liability
To the maximum extent permitted by law, CareFlick, Inc. shall not be liable for:
Indirect, incidental, or consequential damages
Loss of data, profits, or goodwill
Reliance on AI-generated content
CareFlick’s total liability shall not exceed the amount you paid (if any) to use the Services in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless CareFlick from any claims, damages, or expenses arising from:
Your misuse of the Services
Violation of these Terms
Violation of applicable laws or third-party rights
15. Governing Law
These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law principles.
16. Changes to These Terms
CareFlick may update these Terms from time to time. Material changes will be communicated through the Services or other reasonable means.
Continued use of the Services after changes constitutes acceptance of the updated Terms.
